Terms and Conditions of Entry (“Terms”)
1. Instructions on How to Enter and the prizes form part of these Terms. Participation in this Promotion constitutes acceptance of these Terms. 2. The Promoters are Bauer Media Ltd of 54 Park Street, Sydney NSW 1028 ACN 053 273 546 and Generic Publications Pty Ltd of 21A Richmond Road, Homebush West NSW 2140 ACN 104 215 241(“Promoters”) 3. Each enterprise carrying on business at each Harvey Norman complex or online under a name or style including the words “Harvey Norman”, is operated by an independent franchisee (“Franchisee”) pursuant to a franchise granted by a subsidiary of Harvey Norman Holdings Limited ACN 003 237 545 (“Harvey Norman”). 4. The Promotion is open to all permanent residents of Australia aged 18 years and over except employees, officers and immediate families of officers and employees, of the Promoters, Franchisees, Harvey Norman, and any other organisation associated with this Promotion including their related entities. 5. This Promotion may be advertised in Bauer Media Publications (including in Woman’s Day magazine) and on national television, radio, print and online. 6. The Promotion commences at 00:01am AEST on 29th August 2013 and closes at 23:59pm AEDST on 20th October 2013 (“Promotional Period”). Judging of the entries will commence on 21st October 2013 at Bauer Media Ltd of 54 Park Street, Sydney NSW 1028. A panel of judges appointed by the Promoters will judge the Promotion. Winners of the Major Prize and Minor Prizes will be notified by phone and/or email using contact details provided in their entry on 31st October 2013. Names of the Major Prize winner and a selection of Runner Up winners (as determined by the Promoters in their absolute discretion) will be published in Australian Woman’s Weekly December Issue on sale 21st November 2013; Woman’s Day Issue 13 on sale 11th November 2013; TV Week Issue 13 on sale 11th November 2013; Take 5 Issue 13 on sale 7th November 2013; and House and Garden January Issue on sale 2nd December 2013. 7. No purchase is required to enter. Only one (1) entry is permitted per person per pet. 8. To be eligible to enter, entrants must: (a) be a member of Harvey Norman PhotoCentre online; (b) be the owner of a pet; and (c) have personally taken a photograph of their pet within the last twelve (12) months prior to submission of their entry (“Photograph”). When completing an entry form, entrants must include a “caption” in fifty (50) words or less that best describes the moment captured in their Photograph. 9. Entrants agree they will obtain prior consent from any recognisable person or property that is featured in or that is posing in their Photograph prior to submitting their Photograph for the purposes of this Promotion. 10. For the avoidance of doubt, the entrant is deemed to be the person entering the Promotion and not the pet included in the Photograph. 11. To enter the Promotion, an entrant must, during the Promotional Period, undertake one (1) of the following entry methods: a) Complete an official entry form and attach a hard copy of their Photograph (with their full name written on the back of the Photograph) and either: i. Place their completed entry form together with their Photograph in an official entry box located at a Harvey Norman PhotoCentre in any Harvey Norman Complex; or ii. Post their completed entry form together with their Photograph to “Harvey Norman Competition” PO Box 449, Eastern Suburbs MC NSW 2004. Official entry forms are available from any Harvey Norman PhotoCentre located in a Harvey Norman Complex or electronically from Harvey Norman PhotoCentre Online at www.harveynormanphotos.com.au; or b) Visit www.harveynormanphotos.com.au, and follow the prompts to submit the online entry form by inputting the requested details, uploading their Photograph and submitting the fully completed entry form online; or c) Submit an entry via Facebook, by accessing the Harvey Norman PhotoCentre Facebook Page at http://www.facebook.com/harveynormanphotocentre, ‘like’ the page or already be a fan of the page and access the Pet Competition application (“Application”). Then, via the Application, input the requested details, upload their Photograph, and submit the fully completed entry form. 12. Entrants must be a member of Harvey Norman PhotoCentre online in order to enter the competition and for their entry to be deemed valid. If the entrant is not already a member of Harvey Norman PhotoCentre online they must visit www.harveynormanphotos.com.au and follow the prompts to become a member during the Promotional Period. 13. The Promoters reserve the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, proof of age, place of residence or pet ownership) and to disqualify any entrant who submits an entry that is not in accordance with these Terms or who tampers with the entry process. Failure by the Promoters to enforce any of their rights at any time does not constitute a waiver of those rights. 14. Entries that are incomplete, indecipherable, illegible, or do not comply with these Terms are invalid. 15. The Promoters reserve the right, at any time, to refuse to accept any entry or remove any entry that it deems, in their absolute discretion, to be dangerous, obscene, offensive, inappropriate, or infringing upon the rights of any third party. Determination of the appropriateness and acceptance of any entry is at the sole discretion of the Promoters, including as a result of breaching these Terms. 16. If the Promoters reasonably believe that an entrant has infringed the intellectual property of any third party or not adhered to these Terms, that entrant will be disqualified without notice and their entry/entries removed from the Promotion. 17. If there is a dispute as to the identity of an entrant, the Promoters reserve the right, in their sole discretion, to determine the identity of the entrant. 18. This is a game of skill and chance plays no part in determining the winners. Each entry will be individually judged based on its literary, artistic and creative merit of the Photograph and how well the caption showcases the moment captured in the Photograph. The judges’ decision in relation to any aspect of the Promotion will be final and binding on every person who enters. No correspondence will be entered into. 19. By submitting an entry to this Promotion, an entrant consents to receiving a discount offer from Harvey Norman PhotoCentre Online. If the entrant further indicates its consent on the entry form to receive further information and marketing material from Franchisees, the Promoters, Harvey Norman or their related entities, the entrant consents to receive this information and marketing material from any of them, unless the entrant opts out by giving notice to the sender. Entrants should direct any request to access, update or correct information to the Promoters. All entries become the property of the Promoters. 20. The best entry as determined by the judges will be deemed the Major Prize winner and will receive: • $10,000 – This prize will be awarded in the form of a single payment of AUD $10,000 deposited directly into the nominated winner’s account. The winner will be requested to provide their nominated bank account details to the Promoters at the time of winner notification; and • One (1) x Harvey Norman PhotoCentre special bowl with the winner’s entry photograph on it, valued at $34.95; and • One (1) x Harvey Norman Gift Card valued at $50. 21. The next best twenty five (25) valid entries as determined by the judges will each be deemed Runners Up winners and will each receive: • One (1) x Harvey Norman PhotoCentre special bowl with the winner’s entry photograph on it valued at $34.95; and • One (1) x Harvey Norman Gift Card valued at $50. 22. The total prize pool is valued at $12,208.70. 23. As a condition of accepting the Major Prize, the Major Prize winner must sign any legal documentation as and in the form required by the Promoters and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form. 24. All prizes must be taken as offered. The prizes, or any unused portion of a prize, is not transferable or exchangeable and cannot be redeemed as cash, unless specified otherwise. The prizes are not valid in conjunction with any other offer. The prizes are valued in Australian dollars. 25. Harvey Norman Gift Cards are valid for twenty four (24) months from the date of issue and are subject to the Gift Cards Terms of Use, which are available at any Harvey Norman Franchise store (excluding online). The Promoters will not be liable for any Harvey Norman Gift Card that has been lost, stolen, forged, damaged or tampered with in any way. Any ancillary costs associated with redeeming a Harvey Norman Gift Card are not included. Any unused balance of a Harvey Norman Gift Card will not be awarded as cash. 26. Where relevant, the prizes will be delivered to the nominated address of the winners. Delivery of the prizes is valid to any state and/or city in Australia. 27. Prizes are subject to the standard terms and conditions of the individual prize and its service providers. 28. In the event that for any reason whatsoever a winner does not take a prize (or an element of the prize) at the time stipulated by the Promoters, then the prize (or that element of the prize) will be forfeited by the winner and cash will not be awarded in lieu of the prize. 29. In the event that a prize, or part of a prize, is unavailable, the Promoters reserve the right to substitute the prize or part of the prize in their discretion with an alternative prize or part of the prize to the same and equal recommended retail value and/or specification. 30. By entering this Promotion, each entrant consents to their entry (including but not limited to their name, their pet’s name and their Photograph) being used in any feature created by the Promoters. The Promoters are entitled to use any such feature for any purposes at its discretion, including for any future promotion, marketing and publicity purposes in any form of media. Features may appear in/on the Promoters’ media and/or on media owned or controlled by the Promoters. 31. If the Promoters, in their absolute discretion, considers a Photograph is in violation of any laws, the Promoters may report the entrant to the appropriate law enforcement authority and the entrant will have no claim against the Promoters, including for any loss or damage it may suffer as a result. 32. When an entrant submits any materials via the Promotion including comments, recordings and images (e.g. photographs) (“Content”), the entrant agrees to assign all of their rights, title and interest (including copyright) in and to their Content to the Promoters. Each entrant also agrees to sign any documentation necessary to affect such an assignment. Each entrant warrants to the Promoters that the Content submitted is an original work of the entrant that does not infringe the rights of any third party. Entrants consent to any use of their Content which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth). 33. Entrants agree that they are fully responsible for the Content they submit. The Promoters shall not be liable in any way for such Content to the full extent permitted by law. The Promoters may invalidate/remove any Content without notice for any reason whatsoever. Entrants warrant and agree that: (a) they will not submit any Content that is unlawful or fraudulent, or that the Promoters may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication; (b) they will obtain prior consent from any person that appear in their Content or from the owner(s) of any animal or property that appears in their Content; (c) they will obtain full prior consent from any person who has jointly created or has any rights in the Content, to the uses and terms herein; (d) their Content shall not contain viruses or cause injury or harm to any person or entity; and (e) they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others’ computer or communication systems. 34. Entrants agree to indemnify the Promoters against all costs and claims by third parties arising from a breach of any warranty provided by them in these Terms.35. Nothing in these Terms limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoters, Franchisees, Harvey Norman and its related entities (including their respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion. 36. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoters (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of Promotion, including but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoters) due to any reason beyond the reasonable control of the Promoters; (d) any variation in prize value to that stated in these Terms; (e) any tax liability incurred by a winner or entrant; (f) use of a prize; or (g) the entrant’s participation in the Promotion. 37. By entering the Promotion, entrants consent to their personal information being used by the Promoters or their related entities for the purpose of conducting this Promotion and supplying any prizes, notifying the winners, and for any other purpose contemplated by these Terms. The Promoters may share the personal details of the entrants with Promoter’s related entities, and the personal details of entrants may be stored in hard and/or soft copy format at the offices of the Promoters or their related entities unless the entrant requests for their information to be deleted or destroyed. A request to access, update or correct any information should be directed to the party communicating with the entrant. The collection, use and disclosure of personal information otherwise provided in connection with this Promotion is governed by the Bauer Media Group Privacy Notice (see contents page of any Bauer Media magazine title for location in each issue), the Harvey Norman Privacy Policy available at http://www.harveynorman.com.au/privacy-policy, and the Harvey Norman PhotoCentre Online Privacy Policy available at http://www.harveynormanphotos.com.au/privacy. To the extent of any inconsistency between the Privacy Notice and these Terms, these Terms shall prevail. 38. Entry and continued participation in the Promotion is dependent on entrants following and acting in accordance with the Facebook Statement of Rights and Responsibilities, which can be viewed at www.facebook.com/terms.php. 39. This Promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants understand that they are providing their information to the Promoters and not to Facebook. The information an entrant provides will only be used for the purposes outlined in these Terms. Any questions, comments or complaints about this Promotion must be directed to the Promoters and not to Facebook. Facebook will not be liable for any loss or damage or personal injury which is suffered or sustained by an entrant, as a result of participating in the Promotion (including taking/use of a prize), except for any liability which cannot be excluded by law.
